When my father was sick with cancer my mom and I seem to think there was some suspicious things going on between my brother and sister in law when they would take dad for radiation treatments. As the home health nurse came in she was having him sign paperwork about a POA.

POA is Power of attorney. When I googled the State of Virginia and POA, I don't see any indication that the courts have to appoint one. Guardianship, which is what you may be thinking of, it handled through the courts in most states. You should perhaps consult an attorney about what might or might not be going on?
