I came to take over the land and the house of my parents, which I heard my mom and my brother would sell while they already sold half of this land include one big house on it. They sold the land and the house without consulted me and after that they flew to somewhere. Now they came back and told me to move out from this house or else they will call the police. The question is...Do I have any right to stay or should I just leave?? What will I say to the police to prove that I have the right? I am confuse and don't know what to do...

Are you over 18 years of age? I ask because your mom can sell anything that she owns, now if you owned it she couldn't sell it and many states would not allow her to throw you out if you are under 18. Are you okay? If you are sick in some way you need to contact your state and county services to find out what sort of assistance is available to you.

If your name is on the house and land, then they cannot kick you out. If the house is still under your mom's name, then she has every right to do whatever she wants. Did they tell you that they were giving you the house/land? It woud be hard to prove this since it's all hearsay. Perhaps they told you it was yours so that you can "babysit" the house while they flew somewhere. Now that vacation is over, they no longer need you??? Hard to say without more information. But whatever the case, if your name is not on the house/land deed, then you're not the owner and have no rights.

BUT!!! Do you live in a state that has "squatter's rights"? I saw on the HLN news that a family left their vacation home unattended. When they came back, squatters were living in it. The police didn't do anything due to squatter's rights. Strange but true. Who would of that? I mean, it's a Vacation home! Not an abandoned home. Strange laws....

Where is your father? I read that you are taking care of him and he has diabetes. How does he fit into this?

Unfortunately, there's a difference between legal rights and moral rights. Much depends on whose name this property is in, and as mentioned above, your age. I'm so sorry you are in this horrible situation. You may want to contact your state's attorney's office and see is there is any pro bono (free) help available for someone like you.

Thank you guys for your helpful response. For more information, about the land its a family land given my mom by my grandmother. The houses belong to both of my parents like it's their matrimonial properties. At the moment my parents are separated and the thing is my Dad is from overseas and the law in our country they can't register my Dad's name because he is not from here even if he already got his citizenship. My Dad's his a hardworking man, and he is the one who built these houses. My mom she is taking advantage because she's a native. And yes I am over 18 years old. The land it is registered by my mother.

If it is your mother's land and she is in her right mind she can do with it as she pleases without permission from her children. Have you talked with your Mother to find out why she is selling? We don't always like the decision our elders make, but they sometimes have good reasons. If you think your Mom has dementia or is under undue influence by your brother you might get a temporary hold from the court or APS. Just not liking that she is selling the family property isn't enough reason for the courts to step in though.

If the property is located in the United States your father should be the one contacting a lawyer. He has rights in most states to marital assets.
