My brother is not giving me anything, but gave the other 5 siblings mom's money in her bank without me being there, giving property and belongings away as we speak. What can I do? Is this illegal and if so how can I get this situated? I'm humble and just want mom's kitchen appliances and cooking ware because I have a catering business and want the money owed to me. Help please???

If there was no will, why was your brother assuming the responsibility for allocating her assets? How was he able to allocate funds from a bank account unless the account was held jointly with him?

I assume you've approached your brother directly about this situation. What was his position?

My mother had her bank account on her own. Not jointly with anybody. N my brother who was made representative over her property and other assets she owned he left to go back to California. He left it to my other brother karlos without probate courts authority because he is a 2 time felon and knew it be illegal to have a felon be an representative.

Kyiesha, sounds like your Mom's money and other assets didn't go through a Probate. Normally when someone passes, with or without a Will, Probate is the next step.

Since there was no Will, then it would have been up to a Probate Judge to decide, according to State Laws, who will get what.

I would contact either the Probate division of your County/City, and/or talk with an Elder Law Attorney. Let the Court take over from here.

Thank you at freqflyer. It's in probate. I called and that's how I found out that my brother Kevin who lives in California is the representative. Trust me when I say my mom has no will. She died two days after talking to a funeral owner in southfield,MI about obtaining one and I called him recently about month ago and she never got a will with him or anybody. It's filed in Oakland county probate court. I just don't have money for an attorney so was trying get help on doing it myself. I'm a darn good advocate for myself n can handle business as good as my mother lol.

Kyiesha, good, the estate is in Probate. This will take some time. Nothing can be distributed until the Probate Judge signs off on the case. It would be interesting to see if your Brother would need to gather up everything he gave away as the Judge had distributed the items differently.

You can ask the Court if you can file a motion, or ask for an appointment to talk to the Probate Judge. Make sure your name is on the list as an Heir.

Thank you. I actually requested an mandatory accounting. He is going to be ordered to gather everything he gave out and away and bring it back in the house with a court accountant and the court accountant will make an inventory list and Mark the value of everything in monetarily value so now a judge can sum up the value and have it all sold after I pick what I want out. And in Michigan if a person has no will and no spouse the children are automatically next in line to receive what was left in the home , money in the bank, and money after the home is sold. I also put in a request for my brother to account and attest to how much was in moms bank and why I was not given my share. The Judge was beyond pissed off and he said for me to go to Frank Murphy and prosecute for fraud because he saw my mother had over $2 million left in her accounts total and they stole my share and claimed it was only one child living so they didn't have to give me anything and I will be getting custody of my little sister and brother because they never went to a court for legal guardianship . Oh it's very messy but judge was glad I brought it to his attention.

There are minors involved in this and you're posting about wanting your mother's cookware?

My mom also has no will. So when she passes, I was told it goes to probate and all assets are divided equally among surviving children and if there is one sibling that is deceased then his/her share goes to his/her surviving children.

Stay with what you are doing with judge. Make sure he has names/addresses for ALL Children surviving.

In NJ the state gets involved when there is a large amount of money like this involved and they get their share. You should have been notified of probate. Those children underage should have trusts set up with a guardian. With this kind of money involved a lawyer may get involved for a %. Glad u found a judge sympathetic. Not sure why u asked the question when it seems you have done a lot so far.

To country Mouse....it's called being humble. I don't want much but moms cookware and my share or the money for me and her grandchildren that it will go to because I will share my portion with my son's. I want to grieve in peace and happily so me requesting more would be plain selfish of me and not of God. Then to everyone else thanks so much for the feedback and suggestions. I am doing so much because of the tips I have received here because I knew nothing to do at first. But thank you again.

Kyiesha; I think CM's point was that care and guardianship of minor children is usually a great deal more pressing a need than cookware, being humans and all. We understand that you wanted only the cookware and are a humble human being.
