They made themselves in charge, stole everything of value, opened a bank account in California in her name and made themselves the payee of her social security. They left me paying the storage with no funds. Then, when they were no longer able to handle my mother, they brought her back to me. Her safe, containing about twenty five million dollars worth of jewelry, was stolen by my niece. She had access to it because my brother had taken the safe first with the permission of the my older sister. Who also opened the bank account misrepresenting herself and my mother. My brother, who kidnapped her, has died. He was the one who moved her from Colorado to California under false pretenses. They were supposedly going for a weekend trip. However, it was my younger brother that robbed and stole everything out her house. Prior to me, arriving to get everything I left behind. When I originally took my mother in, I took two suitcases and moved her in a plane. Prior to me moving everything else he had already her out. My older sister advised him I was coming. I had come to my eldest sisters, funeral and planned to move her things. I had come to my sisters, funeral and planned to move her things that weekend to my home. But prior to the funeral. Prior to the funeral, I packed what was left and took it to storage in California. He had stolen the safe and all its contents, and placed it in his personal storage. He had already been taking things for my mother. He had already been taking things for my mother for years. He took all the expensive crystal, expensive china and antiques. He was later incarcerated for something else, and he gave the keys to his daughter. She is the one who ponded and most lokely gave everything away. This was all done without my consent. I now have my mother back with me in Colorado, but she has nothing but her social security. I completely support her. I pay for her storage, and I don't even know what's in the boxes. The last time I opened one, it was like filled with rags. They appointed another niece to take care of her. They went through everything I had kept in storage and took what they wanted. They think that they did nothing wrong.

Loss of 25 million sounds fishy. When all of this started, the assigned POA had time to file police reports and hire attorneys with mom's own money to get a handle on this.

Was your PoA active when she was kidnapped? (ie did she have an actual medical diagnosis of incapacity from her primary doctor). If she did then you should have reported the kidnapping. It would have been easy enough to prove they weren't the PoA.

Also, why not report the theft of the jewelry? Usually people have those types of valuables *insured*.

Why were you completely supporting your Mother if she had $25mil of jewelry?

Why are you standing by doing nothing and letting these clowns get away with all of this? If you are your Mom's actual PoA then you have the autority to do report these crimes.

Your story doesn't make sense so please provide more information, like your Mom's mental condition, and the time line, and an actual question.

This needs to reported to legal authorities. Kidnapping and misrepresenting yourself as POA is illegal. Go to the police or sheriff office with your proof.
And, of course, you will NEED proof of all of this, given that your mother, the kidnap-ee, is now back home with you.
Any criminal action is a bit late in being filed, and that may mean that you have no case here.

What action was taken to restore your being the representative payee for Social Security, can you tell us that. Because if you report fraud to SS AT THE TIME IT HAPPENS that is also a HUGE breach of criminal law in getting someone's SS illegally and without proper documentation.

You mention something about the kidnapper dying?
How long ago did this happen?
It may now be out of statute of limitations at this time.
Ordinarily when someone in our family is kidnapped we report it THAT DAY.

Your case is quite odd and I suspect there are many more details we don't know? I surely am sorry it happened, but remember, when there is a criminal action it must be reported to the police at once. A Forum of strangers can listen you a vent about it, but have no legal authority to help you.

This kind of thing does happen. The jewelry should have been placed in a safe deposit box at a bank. The jewelry probably ended up in a pawn shop.

Did any of these people have any legal issues or used drugs?

I would stop paying for mom's storage space. Salvage what is salvageable and let the rest go.

It sounds like it is too late in the season to report anything at this point.
